Legal Aspects Of Workplace Safety, Health & Environment (Re-run No. 100)

The Workplace Safety Health Act (WSH Act) and the present occupational safety health (OSH) framework  have become part of the more comprehensive OSH regime in containing  workplace safety & health incidents & violations that will put the unfortunate plague of major workplace accidents that happened in 2005 behind us. But these laws not only extend the scope of responsibilities & statutory duties (and therefore liabilities) to a wider group of duty holders including employers, designers, engineers, etc but the penalties are even stiffer with fines of $200,000.00 and imprisonment of 2 years and in fact in one specific offence, a conviction may well set back the offender by a cool 1/2 million dollars!!

You will hear from a speaker who is a retired senior lawyer with nearly 29 years of continuous private practice under his own law firm and has many extensive industrial, projects, safety health & environment management experience as a practising engineer and project engineer/senior project manager. Mr. Lee will discuss amongst others, the statutory duties & liabilities under the WSH Act & the new OSH legal framework as well as under the environmental protection laws and will also share his experience as to the reasonable OSH practice to adopt & suggested checklist to follow in order to contain or alleviate such possible pitfalls

1. To provide participants with a general knowledge of relevant criminal, negligence, labour, safety, technical and related occupational health & safety (OSH) laws & legislations including the new Workplace Safety & Health Act and the new OSH framework and to enable them to appreciate and evaluate the impact of such related OSH laws on their roles as Business Owners, Employers, PEs/Engineers, Consultants, Technical Professionals, Managers, Safety Officers or Contractors in relation to OSH legal requirements in their workplace.

 

2. To enable participants to understand & use such general knowledge acquired as well as lessons learnt from the Nicoll Highway, Keppel Shipyard, SMRT & other relevant accidents in order to support their roles as good & responsible business owners, employers, PEs/engineers, consultants, technical professionals,  managers, safety officers or  contractors and appreciate their respective duties, responsibilities & liabilities.

  basis of OSH laws

-         Law of Tort of negligence

·        introduction to the Law of Tort – in comparison to criminal wrong & types of tort

-       Aspects of Labour Laws and Technical Legislations relating to occupational health & safety in the workplace

·        a review of the relevant or pertinent sections of the following legislations which affect and/or entail the statutory duties, responsibilities and liabilities (criminal &/or civil) of  a business owner, employer, PE, engineer, RSO/WHSO, manager, etc

_     Workplace Safety & Health Act (WSHA) & relevant regulations

_     Environmental Protection and Management Act (EPMA)

_     Work Injury Compensation Act

_     Fire Safety Act

·        consequences of breach of duties and possible defence

      -    The new OSH  Framework & WSH laws and their impact

 

·        the new OSH Framework and its impact on owners/operators of workplace, employers, management, PEs/engineers, consultants, technical professionals,  designers, safety officers, safety consultants & safety professionals or  contractors

 

-    Discussion on the Nicoll Highway collapse, Keppel Shipyard incident , SMRT 2016 workplace safety fatal accident and other cases

Speaker’s CV

Mr. Lee Kwok Weng, B.Eng. (Mech.)(S'pore), M.Sc.(Ind.Eng)(NUS), DipBA(NUS), GradDip Mktg.(MIS), LLB(Hons)(Bucks), LLM(Lond), Barrister-at-Law, Advocate & Solicitor (Retired), Supreme Court of Singapore, MMIS, MSIArb, FIES, Honorary Legal Advisor, IES & SISO, a senior lawyer was in continuous private legal practice for almost 29 years running his own law firm before his retirement from legal practice.

 

 

He specialises in Business Contracts, Negligence, Safety & Environmental laws, Information Technology and Engineering, Construction & Building Laws before he retired from legal practice.

 

 

He is a trained practising Mediator and had been a principal Mediator on the panel of the Singapore Mediation Centre for many years before he stepped down to conduct private mediation. He is also an accredited arbitrator.

 

 

He has for many years been an adjunct Senior Lecturer and Associate Professor at the Faculty of Business Admin, National University of Singapore, teaching Business Law in the MBA programme.  He has also for many years an Adjunct  Lecturer at the Nanyang Technological University & BCA Academy.  He is a very experienced lecturer and trainer and is well-versed in the technical field, marketing and management practice too.

 

 

Mr. Lee brings with him considerable industrial project and business development management experience, having worked as a project engineer/manager for more than 12 years in the public & private sectors. Eventually before he switched to the legal profession, he was a senior project manager in a leading Multi-national engineering and construction corporation serving the energy, marine, oil and gas industries onshore and offshore.
